1. Payment Terms
1.1 Our trading terms for payment are strictly 30 days from issue date of invoice. Direct Sales are 30% deposit with confirmation of order with the final payment on delivery of the chair. Interest of 5% base rate will be charged on all overdue invoices. Payment should be made direct to Cura Seating Company Limited by BACS to the account number as advised, in compliance with our invoicing instructions, unless special payment terms have been agreed with our company and confirmed in writing.
1.2 Querying of invoice for any reason should be made to Cura Seating Company Limited in writing within seven working days of receipt of invoice.
1.3 All prices will be those agreed by Cura Seating Company Limited, plus VAT at current rate in force.
1.4 An Order Acknowledgement is sent by Cura Seating Company Limited to confirm your order. This document shows details of the product to be built. Immediate query should be made i f you disagree with the Order Acknowledgement specification given by Cura Seating Company Limited as we only allow three working days for changes to be made. The projected delivery date is an indication only of the anticipated product build and shipping. Cura Seating Company Limited cannot be held responsible for delays beyond its control due to circumstances outside its control.
1.5 Delivery will be by carrier or direct by Cura seating Company Limited unless otherwise agreed.
1.6 Unless the above terms are met, orders will be placed on HOLD until payment is received. This will increase the length of build and shipping time to you. Finished goods will not be shipped by Cura Seating Company Limited if your account is overdue for payment. Legal recovery will commence in five days after the due date and will include interest plus costs.
1.7 Title of any goods does not pass to the customer until payment for those goods, or any other goods delivered to the customer by Cura Seating Company Limited, have been paid in full.
2. Damage in Transit
2.1 Cura Seating Company Limited must be advised by fax or telephone of any damage to goods within 24 hours of receipt. Damaged goods and/or cartons must be noted on delivery note of shipping company if one has been used. If there appears to be no apparent damage, the carriers consignment note must be signed as 'not examined', otherwise any damage subsequently discovered will be your responsibility, as will the cost to rectify the product. This does not apply when delivery is carried out by Cura Seating Company Limited personnel.
3. Limited Warranty
3.1 Our chairs carry a 2 year warranty on mechanisms and wooden frames and 1 year on all fabrics, and are subject to fair wear and tear. Proper installation must take place on delivery of the product.
3.2 Warranty Registration - Each product can be identified by its own serial number.
3.3 It is a primary requirement that all Cura Seating Company Limited chair retailers provide a repair service for users. It is a requirement that Cura Seating Company Limited are notified of any call-out under warranty.
3.4 When requesting parts under warranty the serial number of the product SHOULD be given at the time of the order. If this is not possible it MUST be given prior to shipment.
3.5 Goods must be returned to us using the above procedure; failure to do so will remain as a debt to your Cura Seating Company Limited account.
3.6 It is essential that you check your record of sale to ensure that the product is still under its original warranty, two years from the date of sale by your company.
4. Returns and Allowances
4.1 No goods will be supplied on a sale and return basis by Cura Seating Company Limited. No goods will be accepted for return without prior consent by Cura Seating Company Limited and accompanied by a goods return note.
4.2 Any cancelled order of standard product accepted back by Cura Seating Company Limited is subject to a 20% re-stocking charge.
5. Out of Warranty Product
5.1 When agreed by Cura Seating Company Limited, products returned to Cura Seating Company Limited for repair outside of warranty, will be subject to quotation issued by Cura Seating Company Limited. Work will only be carried out on receipt of signed approval of the Cura Seating Company Limited quotation with your order number.
6. Data Protection Act
6.1 In accepting our credit terms you have agreed to our processing, recording, disclosure and using information provided. We may make such enquiries that we consider necessary in connection with the application or agreement with Cura Seating Company Limited.
6.2 We may disclose information from your application to any fraud avoidance scheme in which we participate or any credit agency we use, which we will keep record of searches, details of accounts including defaults. Such details may be shared with other businesses. You have a right to receive a copy of personal information we hold on you and details of to whom it is disclosed.
